Can a co-signer buy out a lease if I don't sign off on it?
My roommate and I haven't gotten along since we moved in together. Today she left a letter in the mail for me stating that if I didn't agree to sign her name off the lease in 30 days her dad was going to buy out our lease and kick me out. We rent from an apartment complex and all three of our names are on the lease.

I'm not exactly sure what the terms "buying out" refers to. Does this mean he's going to pay the rent for the rest of our lease in one lump sum? And if he does do that can he kick me out if my name is on the lease?

    Thanks!

I guess if the owner of the apartment wanted to see the lease to someone, they could, but the person who bought the lease would just have to obey all the rules, and could not kick you out if they did.

What buying out means he would go to the landlord and ask to buy the lease ( like buying a loan or note) he would pay them a sum of money ( not rent but a purchase of the right to collect the terms of the loan)

So what happens he becomes basically the landlord for all legal purpose, since he would own the lease. But it is doubtful that the apartment owner would do it, since they would still hold some liablity.

But if they did buy it, they would be legally bound to the terms of the lease, and if they tried to kick you out, you could sue them for all damges,

So your roommate is just lying, making threats to try nad get off the lease, if her dad was that rich, her dad would just pay her rent to the end of the lease, and let her move out .

so just laugh at her and tell her go ahead.

Like Chuck I seriously doubt if an apartment complex would allow such a buyout. Maybe a small landlord would, but not a complex.

However, I would make a counter offer. Tell her, if her father wants to spend his money, then buy her out of the lease. Just give you an amount equal to the remaining monthly rentals on the lease and you will be glad to let her out of the lease.
