I have a 19 yr old son whom dropped out of high school, does drug, disrespects and talks down to me like I am nothing. And recently was brought home by the P.D for shop lifting a bottle of jackdaniels from the local grociery store. When the P.D showed up at my door and asked me to identfy my son and explained what he had done I told him I did not want him at my home any longer. We have tried for over 9 months to have him get a job. This kid eats us out of house and home and doesn't contribute a damn thing. He has yet to get a job. But the officer said that I had to evict him because he has a room in my home.
I'm confused by this since all over the parents I have ever talked to said just to kick him out. He's never had a job to rent this 'room' from us. So why would I have to legally evict him?
Was this officer just feeding me a line?

I think he just did not want to do the paperwork. Cops hate paperwork for something silly like this. Believe me I have cop friends. You can change your locks and simple deny him access. He is a guest not a renter. He has to prove that he pays rent, in writing.
Lets say as an example he moved out and went with his girlfreidn for a couple of years. You do not touch his room and leave it intact. He breaks up with his girlfriend, he can't just come back and say "well I have a room here". It just doesn't work that way.

Dismantle the room. Maybe keep his stuff in the garage.

A renter is someone who has an agreement and pays rent. Check your state laws though. What state are you in?

Police officers have no "law degree" and are not part of the eviction process even. So it is doubtful he has any expereince at it.

And even so, if it is not legal, what is your son gong to do if he comes back and the doors are locked, he causes a problem, you call the police and tell them no he does not live there, who cares, he is out.
He has no rental agreement, he has never made any payments to make any type of intent.

Now if this is Canada, it can be different, But at times I have to personally say, so what, what can he do even if it isnot legal, sue you, based on what ?
