5yo boy,mom and 13yo girl share bedroom. Can dad try for custody of son?
My ex lives at her mom's house since we separated almost 5yrs. Ago,she has no vehicle,no job and recently loss her license from not paying excise tax. She has custody of my 5yo son who shares a twin bed with mom and the tiny bedroom with his 13yo sister. Recently she has a new boyfriend and she is over there quite a bit and takes my son with her. I have a two bedroom apartment and live alone,I work full time mon - fri, my son has his own room when he's with me and recently he has been telling me "daddy I just wish I could live with you". I am concerned about this and other issues but don't know where to turn. Can I try for full custody of my son?

You can try. Is your son the child you both had and her daughter from another relationship? Or are you asking about custody of both children? The courts are reluctant to split up siblings but with the conditions you describe and if liberal visitation is involved the courts may allow it. We can't predict what will actually happen.

Yes,her two daughters are from previous relationships and she was never married to any of the father's(including me) and my son is all I would be asking for. Thanks

The bedroom arrangements you describe are not that big a deal, in my opinion.
