    No restitution pmts
    Im a victim of a 2nd degree battery attack! Defendant was arrested charged and convicted ordered to pay restitution of a large amount! Four months after individual was to start paying restotution still no pmts! Spoke to PO! PO says defendant is on workmans comp and may take a while to get pmts started but said it would be enforced! PO also stated if def is arrested for nonpmt that I would not get restitution for medical bills! If def goes to jail for pribation violation then isn't he still responsible for restitution?

    Please don't use all those exclamation points - it just makes your post difficult to believe.

    I would believe what the PO told you. The attacker can't pay if he has no money. You can always attempt to take the attacker back to Court and reopen the matter - but I doubt if a Judge will allow that.

    When you agreed to these terms did you realize the situation concerning income/payment? Did anyone explain it to you?
