If he and his attorney believe the case against him is so strong (despite the fact that it supposedly happened over three years ago to a one year old) that he should make a plea to a reduced charge, believe me, he did it. Therefore you would be crazy to even consider having anything to do with him, let alone allowing him to live with a 13 year old child. But, to answer your question, whether he is allowed to, by the court, will depend on the terms of his probation (if he is given probation or parole after he serves the time).
