A friend' daughter had a baby and about 6 months ago was killed in a car accident. The man listed on the birth certificate who was thought to be the father, now has the child. The girl was white, the male Hispanic, and the child is a blond haired blue eyed little boy like his mother, with no Hispanic features at all. No way this Hispanic male could be this child's father.

The male gained control of the boy about 3 days after female died. He is also receiving $1200 dollars a month for the child. The male had nothing to do with the child for 6 months after he was born, until the baby's mother was killed and all the money came into sight, left the female while she was pregnant, and then got another girl pregnant.

A judge is refusing to listen to the girls parents and will not permit the "real father" who has come forward to submit a paternity test. The baby looks just like the "real father". Is there anything you can tell me that would help the grandparents/real father to get this child away from these money hungry people?

First, genetics can be very funny, just because the child doesn't look like the legal father doesn't mean he isn't. On the other hand, on what grounds does the judge refuse the case? Under TX law, the possible bio father has the right to petition for custody. Does he have an attorney?
