    Follow-up questions regarding my previous topic - F1 OPT - H1-B

    I have 1 W2 where Social security tax is withheld along with medicare tax.

    So while filling out 1040NR/NR- EZ , where do I enter this information? I do not wish to claim a refund on social security wages or medicare wages.

    That information is NOT entered on the annual tax return.

    First, go to your employer and ask that the FICA (Social Security and Medicare) taxes with refunded to you. You can show him pages 52-53 of IRS Pub 519 to prove that these taxes should not have been withheld.

    If that will not work, you will need to submit Forms 843 and 8316 with other support documents to get the refund direct from the IRS.
