Question about Marriage (Fiance is on visit visa)
    Hello All,

I am on GC and will be applying for Citizenship in Nov 2014. My Fiancé is on visit visa but her visa is expiring in Feb 2014, what would be best option for me?

    1. She stays here and is there a way I can apply for her being on GC and make her stay?

    2. She goes and apply again for visit which is not guaranteed

    3. She apply for F1 but long route as need to do all work and applications

    4. Stay here and become illelagal and wait for my citizenship?

Please advise that what is the best option in this case?

Well, first, when are you planning to get married? After you get married, I think the best thing would be for you to file an I-130 petition immediately (but as an application for the spouse of a permanent resident, there will be several years' wait), and she leaves the U.S. before her authorized stay expires. When and if you become a citizen, you can upgrade the petition and she can adjust status immediately. She can come and visit you more times during this wait if she still has a valid visa, but she will not be able to stay here.
