My wife is co-excutive and co-trustee of her mothers estate with her sister. We live in Oklahoma and the estate and sister are in Washington st. the problem we have is there are annuities and a home that is to be sold and to be split among several familiy members. The investment company has issued payment for the annuities 2 months ago. The problem is that the sister is trying to stall the disburssment of the funds and the sale of the home. As everything needs both trusstees signatures nothing can be done without the sister. What can we do to force her to stop holding up the distribution of the estate as outline in the will?

Your wife needs an attorney to represent her in the probate court to force the distribution of estate assets. She may be able to appear by telephone, she needs to ask the court about that. But the only way to get things moving is through the probate court.

Don't forget that until the home is sold, property taxes and utilities and maintenance have to be paid by the estate. Is there enough cash to cover all that? And do you know what the annuities paid, if anything? Not all annuities have a death benefit. Is the sister living in the home, or is it empty? Have the contents been dealt with?

But as noted, it can be forced though court, she will need to hire an attorney to represent her interest in court
