    I am sending a 1099 misc to a contractor (2 days road work over 600.00) Can I use my
    I am sending a 1099 to a paving contractor it was work performed on a farm. Can I use my Agriculture Tax ID number or should I use my SS number. It is a sole P. not LLC or corp. I rather not have him have my SS number kind of a seedy person but we paid for repairs 7200.00 and I need to at least use it for long term expenses. (Depreciation)

    Make TWO versions of the Form 1099-MISC.

    Put your agricultural tax ID # on the 1099 that you send to the seedy person; that way, you need not worry about identity theft.

    Put your SSN on the one you send to the Social Security Administration.

    OR

    Contact the IRS and get a new EIN, and use that EIN.

    You mean send to the IRS?
    Are you sure about two different numbers? I ran into huge problems 2, 3 years after the fact from a 1099 that didn't match. IRS decided that I hadn't paid taxes and it took a lot of work to convince their little pea brains. I finally wrote a nasty letter using a red crayon. They sent me a form letter saying that they decided to 'waive my tax liability.' The IRS never admits they are wrong.

    You are right.

    The RED copy of the W-2 does NOT go to the IRS; it goes to the Social Security Administration who eventually shares the information with the IRS.

    The RED copy of the Form 1099-MISC IS sent to the IRS. As long as the OP's SSN (the actual tax ID #) is on the form sent to the IRS, he will be fine. The OP is trying to protect his identity.
