I believe that driveway easements are pretty much the same in all states - they are to be kept unencumbered at every single moment. No 'I just have a guest for an hour' or 'I'm entitled to the left side and you can do what you want with the right.' NOTHING can be placed on them, built on them, planted on them, and they can't be altered without mutual agreement.
But of course disputes end up in court all the time, so tell us the situation in detail.

If you have a shared driveway, the easement should be spelled out as part of the deed. Or are you asking about new construction?

Is this in West Sussex UK? Laws in England are a bit different than the USA. Here is what one source has to say "•Shared driveway - without a right of way you cannot access your property. Not only will you need to ensure that there is a right of way that you can benefit from, you will need to identify whether this right provides for both vehicular and pedestrian rights of way."

Shared driveway with a fence at back part of driveway [ 2 Answers ]

We have a shared driveway with our neighbours. The portion of our driveway that is closest to back of house and yard is so narrow that it is impossible to park a car there. As a result we decided to fence in that portion of our upper driveway to add to our patio area. We built the fence in approx 6...

My question is about a shared driveway agreement. In the signed agreement it states- "the maintenance of the driveway is to be split 50/50 by both parties upon agreement" but does not go into detail about what kind of maintenance. In my case, my neighbor is saying that both him and I are...

Shared Driveway [ 3 Answers ]

We live in Maryland on a shared roadway/driveway--our house is at the very front of the property. There are 6 other residents on the road. We are having a disagreement regarding how the cost of repairing the road should be shared. Because we only have acess to 50% of the road, we think that we...
