Lawyer lying to judge about his clients attendance in court mandated parenting course
Hello, on the day of my divorce we were supposed to hand in a certificate of completion from mandatory parenting course necessary for divorce in Massachusetts. I turned mine over to my lawyer for the case file. My ex-husband did not attend the course. When our lawyers discovered that he hadn't gone, they said to just keep quiet about it. While in front of the judge, the court asked if we had both attended and his lawyer said he had, knowing full well he had not. The court failed to look in the file to check the certificates. If the court were to find out his lawyer blatantly lied about this, what consequences would he face? Thanks for your time?

    Hello k:

That would be a good question for YOUR lawyer.. After all, he MUST have had a strategy for keeping quiet about it? I can't see how it benefited you.

Of course, he works for YOU. If you INSTRUCT him to tell the judge NOW, he MUST do it. Unless his answer satisfies you, I absolutely would have him do that.

An attorney who knowingly lies to the court may be subject to disbarment.

But what good does it do you to report it unless it will change your divorce decree.
