    Odd situation eviction laws? Help!
A lady I know agreed to let me live with her rent free until I get a check I have coming to me. She had an argument with and got punched by another female that I am friends with. I was not around for the fight and it did not happen at the house. Never the less, she wants me out and keeps doing hateful things to my property. We have already been told that she has to legally evict me, if I do not just voluntarily move out, which I am trying to do anyway.do the normal eviction laws apply to this situation? There is no written agreement of any kind, I am wondering how many days must I be given, once she goes to get the notice, to get my belongingsd off the premesis?

Yes, normal evictions laws apply. Basically, anytime someone has established residence on the premises, they are considered a tenant and subject to local eviction laws. Nothing has to be in writing, no rental needs to be established. Just the fact that the person lives on the premises.

Since you have neglected to give us the vital info of your location (ANY question on law needs to include your general locale as laws vary by area.) we can't give you any specifics.

The first step is a vacate notice. This should give you 30 days to vacate. If you are not out within the 30 days, then she files for an evciction order. That requires a hearing. How ling before the hearing is scheduled depends on the court calendar. At the hearing, the eviction order will be issued, generally giving you 7-14 daysto vacate before your stuff is removed.

Thanks scott, you were really helpful. 30 days is way more than enough time for me, I am planning on leaving asap. Have a great new year!!
