I am 32 and a single male. A year and a half ago my brother was released from prison after serving 11 years. He said he had no where else to go so I allowed him to move with me in my 1 bedroom apt. He said it would only be 6 months and here we are 1
1/2 year later.

He is working now and say he makes minimum wage. At first he started paying rent and then stopped paying 4 months later. I never said anything and continued to let him stay. He was back and forth from his girlfriend house to my house until she had to move out from her apt. to her friends house last month. When he was at his girlfriends he would stay there during the week and just pop up at my house anytime. He would also bring his son over on weekends to my house.

I am feeling like he is not repecting me at all. I have a girlfriend who doesn't live with me that I can't spend time alone with because he is here. I just need him out. Am I wrong for wanting him to move out? If not how do I break this down to him?

Put it in writing, just as you have done here, and say that you have to have your space back for the sake of your own relationship with your girlfriend, and that you have given up your privacy for HIS sake much longer than anyone would expect. Depending on his response, be prepared to have to evict him according to the tenant laws of your state, starting with a notice to quit. You don't have to have a reason, but back rent can be a good one. If you want help with the laws of your state, answer back. Most states are 30 days notice (FL is 15; CA is longer in some cases), and some states require a calendar month, so give it to him on the first of Jan. You could have a witness when you give it to him. It doesn't have to be on a special form.

You have more issues if you can't just tell your brother that hey, 6 months is long over, you are not paying rent, you got to go.

But it in writing and if he does not go, evict him.
