    I have a daughter that wants nothing to do with me, so I want to give up my rights.
    I have a daugther that wants nothing to do with me. She went to her dads in February of 2012. Its been almost a year and I have tried to talk with her, but she won't. She is living with her step mom and real dad, and wants her to step mom to be her mom. I am tired of fighting with her I am tired of trying to talk to her.

    I want to give up my rights as her mother so she can be happy. How can I do that?

    If the new step mother wants to adopt and the father will agree, and does not mind giving up any future child support, ( you will still owe for the time up to adoption)

    Then you can sign over your rights for the adoption.

    If they don't want an adoption you can not just give over your rights.

    You can best make her happy by leaving her alone without all the courts and hassle. I doubt a judge would relieve you of your rights and obligations to your child without a lot of co operation from dad and the stepmom.

    Just leave her alone.

    If she is going to be happy with that... pls do so! The challenge our world is facing today is finding the right place for our children to have comfort and safe in and she's just found it from her Dad and a loving step mom.
    It looks like she is uncomfortable with your attitude... so don't give up your rights but your attitude!

    Has there been ANY court action over custody? How old is she? If the courts awarded you custody, she can't just move in with her father. He would have to file for a modification of the custody order.If the father does have legal custody, are you paying child support?

    You cannot just give up your rights. Only a court can terminate parental rights. You can however, choose not to exercise your rights. If she wants nothing to do with you, then leave her alone. Giving up your rights will not change anything between you. If you are responsible for child support, then having your rights terminated will not change that even in the unlikely event a TPR was granted.

    However, as Chuck noted, if the Stepmom wants to adopt her, you can then agree to the adoption and, as part of the adoption, your rights will be terminated.
