    Probation
    I am on Probation on Theft by taken and I have to make a monthly payment until the debt is paid off. I don't have to see my PO every month, but I make a monthly phone report. My family has moved overseas and I want to join them soon. I know I can get a permission to go visit them, but what happened if I don't come back? Will they be still after me? I don't have any property here and no other debt. By the way that Company that I used to work for( theft by taken) have gone bankrupt Ch 11 and we can not find what happened to that account receivable. What should I do?

    Hello k:

    If you abscond, there'll be a warrant out for your arrest. That'll last FOREVER.. I don't know IF you're moving to a country that has an extradition agreement with the US, but MOST country's do. So, the cops where you're going MIGHT arrest you and send you back, or they might not.

    If you don't come back, they will put a warrant out for you for violation of probation.
    If your passport is not canceled, it will not be renewed and you will be deported at some point and time and returned to the US.

    1. the fine does not go away or the repayment merely because they went out of business. The bankruptcy trustee is the only one that can delete the debt, You can hire an attorney to petition the court to stop payments with permission of the bankrutpcy court.

    2. You can ask for permission to move, and just report in by phone ( skype works great) and just continue to pay

    OK, I understand. But how can I find out about the Company's assets as far as trustees in Bankruptcy court. That account receivable that I am making payment monthly is sold to another company with all other assets. I was told, that account receivable might be sold 6 Cent on a Dollar or might be abandon. Either way I will be in a better position, that's why I need to to find out about that. The Company went bankrupt in 2009 chapter 11 in New York, which is out of state for me and very far. What are my options to find such information. I am willing to hire someone to do this investigation, but I am not getting any where. Please advise.

    Hello again, k:

    You're being ordered to pay the money back due to court order - NOT because the company deserves it. Even if you PROVE the company no longer exists, the court order will stand.
