    I live in West Virginia. I know the legal age of consent is 16, and he will be 18 in January, and I am 18 already and was before the sex ensued. But we've been having sex for a few months now, and his mom hates me, I just want to make sure that she can't get a wild hair up her butt, and try to prosecute me for rape.

    As you are both over the legal age then no charges can be brought in this instance.

    No, you're misunderstanding me. He is 17 right now. He'll be 18 January 20th. I am turned 18 in August and we started having sex in October. Is this legal since the age of consent is 16?

    However, since he is under 18 and, if his mother refuses to allow you to see him and you continue to do so, you could get in trouble for parental interference. There is more than one way to skin this cat. While he is a minor you need to tread lightly.

    She is already sending him to New York because she doesn't want us together, and while I abide by her rules to stay away, he doesn't. He sneaks out to see me and this last time we got caught and I'm getting blamed. So can she really charge me, if I'm not attempting to contact him?

    When he showed up at your home, did you tell him that until he's 18 you can't see him and tell him to go home?

    If you let him into your house you become at fault because you are the adult and supposed to be the more responsible party. If he's 17 he doesn't have long to wait until he doesn't have to do what his mother says.

    I do tell him he can't see me, but I don't ever let him into my home. We usually hang out in a very public place. Like the mall, or Walmart. It's a bit late to "listen to what his mother says" He's leaving at the end of the week for New York. That's final. Additionally, can you tell me what it means if she issue an incorrigible youth warrant on him? I did some research on it, but it's still very confusing.

    What it sounds like is a way of controlling a minor who is acting in defiance of the parents.
