I want to revoke my sons biological's fathers rights so my husband can adopt him
My son is 2 and I have a restraining order on his bio father. Since April of this year. His father was very abusive to me and mean to him. I filed for child support long before the restraining order but I don't want it, I want his rights taken away. My husband now wants to adopt my son but the way his father is he is just not going to give his rights up just for spite. His fathers family is very bad people they do drugs, not a single one of them work including his father. How do I go about this and do you think it's possible for the judge just to take his rights away without his permission?

Yes, it's possilble. Your husband would petition the court to adopt the child, the boy's father would be duly notified, and if he doesn't consent the court would decide whether the adoption will be approved anyway. Get an attorney to guide you through the process.

We go to court on thurs for child support, when we went to court for the restraining order the judge told his father he would have to get a DNA before this court hearing. Well he hasn't and he still does not have a job so what do you think will happen since he has not completed the steps on his part? And how will they base his child support if he has no job? And will they reverse the restraining order?
