    Do I sign for a simmon to court
    I have a person who call me and said they were going to serve me a simmon that needs to be sign. They state that I owe a payday loan that aI didn't even sign for it just appear in my account. I have argued with these people since May they have not sent me any documents with my signature on it ever time I ask they state they will send my paperwork but never do. What do aI do in this case should I sign it if they come or check with the courts?

    If you don't accept the summons to appear in court, they will at some point have court without you there.

    You need to find out when court is, hire an attorney and appear.

    Signing the summons, just acknowledges you received it. It doesn't admit guilt or responsibility. You go into court claiming that you never took out the loan and they have no proof that you did.

    No, you don't sign anything. The process server, if and when he/she comes to your door, will give you a copy of the summons and the complaint; you don't have any choice in the matter. At that point you will have been "served", and it will be your responsibility to defend the lawsuit in court. You would file an answer and the case will be scheduled for hearing.
