    Probation
    My husband did 2 yrs in Florida prison,which was all the time he was given plus 5 yrs probation.He ha done 3 1/2 yrs probation and now ha violated it for a disorderly conduct.His probation was transfer to Ohio by Interstate Compound, He has been sitting in jail in the state of Florida for almost 2 months have not once had a plea how much time is he looking at if anything.He was protecting his son from being choked by another adult and my husband hit the man and he is the one that got arrested Florida didn't come for my husband his PO told him Florida wanted him by a certain date and we paid to get him there by that time.He also had a dirty UA at the time he saw his PO in OH, which he was up front about. He was in prison for a felony 2.

    He can go and get 5 years on the violation, how much served does not matter. He could have one day left and violate and get the entire 5 years.

    Is he in jail waiting on the probation violation hearing ( you don't plead for that, you merely present your case why you should not go to prison)

    Or is he waiting for trial on the new charge but can not be released due to probation violation hold ?

    Why and how he is being held makes the difference.

    If he does not have one, he needs an attorney and either get case dropped if this is how it actually happenend. Or make a plea deal of some type.

    His hearing was done here in Ohio for the disorderly conduct so that is over with he was fined 300.00.Yes he is in jail waiting on probation violation hearing his attorney came to him the other day with a plea which he did not accept.Records of what really happened here in Ohio was sent to State of Florida .It was for assult until it was proven different.And that is how he got dropped to a lower charge.So there is a plea deal going on at the time.He has been there in jail for over 52 days and has seen attorney 2 times.And he was told by her that is why he has not be to court yet cause they are trying to agree on a plea deal .He is schedule again for the 4 th time for hearing this week going to have to see what happen next with this.
