    Change counsel
    I want to get another court appointed attorney. Mine is not representing me adequately:confused: How to I do that? I think it's called Marsden form but I can't find anything on it.

    Hello punky:

    The court doesn't supply appointed attorneys for family law situations. But, if it's criminal law you're talking about, send him a letter firing him. Send a copy to the judge. The judge will or won't give you a new attorney.

    Well I guess I have to ask why are they not doing a good job.
    Are they showing up at all hearings, are they making sure that everything is done according to all the legal rules and procedures ?

    What else are you expecting them to do? They will I am sure work out a plea bargin.

    Public defenders are normally limited on time and budget, and are not going to look and do what you see on "law and order"

    When he was assigned to me he was on vacation 30 days .my husband was appointed another attorney. His attorney spoke for my lawyer (Conflict of Interest) I called his office the day he was assigned to me and a few times a week after that. I dropped a letter calling for action on the 8th of Feb. he refused to return my calls my friend told his secretary we would file a formal complaint against him, she called back 2x that day. I finally got in on the 9th of march. He told me "I didn't know you wanted to fight." All of our proof couldn't get in front of the judge and now he's saying it's too late. I'd say he could do a little more even for a public defender. I have an A.S. degree in Criminal Justice and certificates of completion in Law Enforcement and Corrections, I don't think I was expecting "Law & Order" just Justice! Sorry if I seem angry, my babies have been gone a long time now and this is not the justice system I've educated myself on and Loved.

    Stop what you're doing!! STOP!! Don't have "your friend" speak for you. DON'T threaten your lawyer!! Don't do your communicating any more by TELEPHONE. Use the mail. Send ALL of your correspondence certified, return receipt requested.

    IF you screw this up, your little butt is going to go away... Do you understand?? You've probably already screwed it up by poisoning your relationship with YOUR ATTORNEY. That's not a guy you want pissed off at you. Yours is. So, it doesn't matter what HE did or didn't do. What ruined your relationship, was what YOU did.

    Ok, it's ruined. Never mind who's to blame. You MUST have a new lawyer. Do like I said originally. FIRE him by mail and send a copy to the court. You certainly may cite the ruined relationship, and your right to counsel.

    DON'T DO ANYTHING OTHER THAN THE ABOVE!
