    SOL in regards to car loan
    Hello,

    I originally bought a car in 3/99 in the state of Florida. My job relocated me to Connecticut, and about 9/01 I defaulted on the car loan, and turned the car into a local dealer in CT. I relocated back to Florida in 2002 and since turning the car in back in 2001 I never heard anything in regards to this loan. On 3/07 I received a summons that I am being sued. Please advise if I have a case in regards to SOL? Do I need an Attorney to file for a motion to dismiss, or is this something I can try and do myself? I currenty own a car, and am nervous that the car can be taken, or my wages garnished. I am a single mother, with dependents.

    Hello ah:

    There are a lot of issues that will affect the statute of limitations. IF you think that they may have elapsed, then you're absolutely going to need an attorney to argue that for you. The other guys have attorneys and they'll flatten you. It doesn't matter that you could be right. Court isn't about who's right. It's about who wins.

    If you think that they may not have run out (and you've got two different state SOL's to deal with), then you might want to negotiate with these people. If they win a judgment, they may not be able to garnish your wages in Florida, but they can attach your bank accounts, and they might be able to get your car.

    After all this time, they'll probably accept a lot less than they're suing for.
