    Paying back arreages for my three kids
    I was the father of three kids and I currently owe 38,000 In back child support about a mth ago I signed over all my rights to my kids mother and her new husband now I'm paying about $800mth in child support and it's broking my pockets how can I get these pays lowered so I can support myself .

    First you can only sign over your rights though the courts, I assume this was to allow the new husband to adopt.

    If this was not the case, you need to check with your attorney, since seldom can anyone sign over rights unless it is an adoption.

    You will need to go to family court and show your income and have payments based on that income. Same as you would have done when you were not paying to get 30,000 plus behind. They will take about 20 to 25 percent of your income toward the support.

    They do not care how you support yourself, for back support some judges are very unhappy, esp with such large amounts unpaid, ** lucky you are not in jail, in my state most people that far behind are in jail for a wihle**

    But it will be based on your income, if you are paying more than 25 percent of your income it may be worth going back to court.

    *** that is assuming you signed over rights for an adoption.

    Also you could have not signed and requested that all back support be forgiven in exchange for signing over your rights, while not always approved by the judge is it at times.

    By saying was, and that you signed over rights, I'm assuming your ex's new husband did adopt the children. While that ended any future obligation, it did not end the arrears.

    As Chuck noted, to reduce the payment you have to go back to court and prove that the amount is a hardship for you.

    Who exactly do you owe the money to? Do you owe to the state on any part of it?
