    Can I sue my husband's girlfriend for the charges on credit cards
    My husband opened credit cards without my knowledge then used them on his mistress. He purchased dinners out, hotel, vacations, and more for them on the credit cards. She knew that he was married. I believe she was stealing from my family budget every time he paid. I filed to dissolve the marriage last week. We live in California. Can I sue his girlfriend?

    In a perfect world it would be nice to be able to do that. However, you can't. The card, I assume, is in his name. She has no financial bearing on this whatsoever.

    Why sue her? She didn't take the cards out by falsifying your information.

    Unless she was using the cards unautherized (which is not the case as you described)... it was your husband that made the purchaces.

    And even if she was. Then it would have been an issue between your husband and the credit card companies. I assume your name wasn't on the cards.

    You can sue anyone, whether you'll win is another matter entirely.

    It's unlikely you would win such an action as it was your HUSBAND and not her that was spending on the cards. Just because she knew he was married has no bearing on racking up any debt.
