    Is this a HIPAA violation ?
    An employee is on vacation and receives and unwanted phone call about her friends prescription. Employee brushes it off and tells the pharmacy tech that its not her business and she doesn't care... Later on the friend is told that two techs who received the script are discussing the patients meds that had been called in by someone who overheard the conversation. The patient therefore calls her friend ( the employee on vacation ) and tells her the situation. The employee explains that she is on vacation but did receive an unwanted phone call about the matter. Did the employee commit a hippa violation ?

    I don't see any HIPAA violation at all. The vacationing employee didn't discuss any details of the patient's (friend) diagnosis or treatment, correct? The pharmacy techs were discussing the matter among themselves I assume to determine how to fill the script.

    Why is anyone calling the "employee" on vacation unless the "employee" is a Pharmacist?

    I was married to a Pharmacist and he never took time off when a Tech didn't call about something.

    Am I missing something?
