    Failing a cdl drug test
    Hi I'm very worry for beening very stupid I used cocaine for very fist time an I paid for the price I fail my job drug test but was not fire I went to a program an I finish will this record goes on my CDL an will it affect me on my next applying job... iwant to apply for this company but I don't dare so won't look stupid that I am now for using that stupid drug... dammm what a shame... thank u..

    This was a DOT test, you were referred for treatment and then were cleared to return to work?

    Assuming you are applying for a similar position requiring CDL any new (prospective) employer is required to conduct a Drug and Alcohol Background check and request records from your current employer or other employers within the past 3 years. See summary of 49 CFR Part 40.25 and your current employer is required to forward that information.

    Thank you for the answer Dr Bill 100... but this will stay on record on the CDL or DAC is like if I apply for this company an they do a back round check will it come back an bite be. I;m not trying to get away fro it but I would like to be ready for it due to this damm stupid mistake is like I lose everithing after I was doing damm good now this will be afte me for the rest of my l;ife just tell how long it will stay on your record if you know... thank you very much.

    As I understand the requirement as cited above (49 CFR Part 40.25) the new employer can only request records dating back for 3 years. You must sign a release for those records. The forms are designated by federal statute. As these records are deemed confidential and must state on the form the time requested that limits what the current employer can provide and subjects them to penalties under other federal regulations should they provide additional information that you did not specifically authorize. So, it seems to me that this can only follow you for 3 years. Employers have no discretion in handling this type of record.
