You would have to define what you mean by "kick him out". You may demand that he leave, and he can refuse. You may not, however, forceably eject him.

The fact that he is on the mortgage note is of little or no consequence. His taking you "off of the deed", by the way, may be cause for the lender to invoke the "due on sale" clause of the note if it was done without permission by the lender.

You can't just kick someone out of their home. Nor can someone just remove themselves from a deed. So you question needs more details to be able to give advice.
