    I own a 1/3 of a home from my mother and father one brother lives there two of us wa
    I own a 1/3 in ahouse left to the 3 of us brothers one is living in it 2 of us want it sold . My mom had live in rights but is now under my care. Can the 2 of us force the other brother to sell without getting messy in courts

    You can't force a sale without going to court.

    How exactly were her rights created, and how were they terminated? I ask this, because a partition action might become more complicated because of those rights.

    Your mother and father didn't 'leave you the house' if your mother is still alive.
    Were both parents' names on the deed when your father died?
    Does your mother agree to live with you and not in the house?
