    Estate Executor - mobile home
    I am the estate executor of my mother's mobile home, in a park that charges a monthly rent for the property upon which the home rests. I have not gotten far with the actual collection of assets, since I just became the executor 2 days ago. My question is this: While the home is for sale, the estate owes this monthly rent to the mobile home park. After about 4 months, there will be no money left in the estate account to pay this rent and mortgage. Do the park owners have to wait for the home to be sold in order to collect any further rent that may be due to them?
    I am asking this question in anticipation of potential issues.

    I don't think they have to wait. You could, if finacially able, pay monies on behalf the estate, and then recover those monies expended from the estate, just save your receipts, etc as proof. As executor you are charged with gathering all estate assets, paying all estate expenses from estate funds if any and then settling the estate by paying off rightful heirs as per your mother's last will and testament. If there are no funds in the estate, then anyone can file a claim againt the estate to seek recovery. They may have other lawful recouse againt the estate an you might not like the consequences of not paying but that's something you have to decide. Either let them take whatever legal action they desire or pay them yourself and then you seek the money back from the estate.

    Sorry but no they don't have to wait, while the home is in the park rent must still be made. Make sure you don't let the rent go into the 3rd month of non-payment, or they can and probley will take court action.
