    Can I overturn this action
    I was at Walmart with my sister house shopping while I was there I turned my back a few times on my purse which is a no no and I get to the checkout lane pay for all of my things which total $80 walk out and the security comes up and say I took a $5 bottle of nail polish and I said I didn't they said its in your purse I looked and it was I said I didn't put it in there and they said we have you on camera but they don't. I don't know wheather it was my sister or the secret shopper who did it because the secrect shopper was following us for a while and I turned my back on my purse a few times when I ask to see the video they refused and called the cops who also lied and threaten me either I sign the civil suit paper or go to jail and I'm in school for nursing and have a little baby so I signed but I didn't do it so my ? Is 1st can they get in trouble for lying like that I mean obviously they don't have proof cause I didn't do it is that a lawsuit for them and 2nd will that affect me and my record can I try to fight the civil suit

    There is absolutely no reason for a secret shopper to put anything in your purse or accuse you of stealing when you were not. You're saying the secret shopper was able to put the nailpolish in your purse and neither you nor your sister noticed?

    Anyway - they don't have to show you the video at this point. There is no "obviously they don't have proof" in this situation.

    I have no idea what civil suit you think they are going to file against you and I have no idea what you signed. Did you sign an agreement to make restitution (pay the store back for the merchandise, time and trouble)? I never understand why people who didn't commit a crime sign a document that they did.

    Yes, if you were or are arrested you will have difficulty getting a Nursing license.

    If you did not steal then do not pay restitution, go to Court on the theft charge, argue your case, at that point you will view the video (as will the Judge), be found either innocent or guilty. Maybe you'll be found not guilty.

    If you believe you were "framed" contact an Attorney and sue the store, particularly if a FALSE ARREST will keep you from getting employment in your chosen field.

    Well I said I don't know whether it was the secret shopper or my sister and no. I didn't know I spent $80 another $5 wouldn't have hurt I wouldn't dare put myself or my career in jepordy for $5 you know and yes they said the paper was for me to pay them back I only signed because like u said earlier the officer threaten to take me to jail and I have a baby at home so of course I'll automatically take that option I'm mad at myself for it now because I should have just let them take me to jail but @ the time all that was in my mind was my baby's

    You haven't asked your sister?

    You wouldn't be the first or the last to spend money in a store, think the prices were high and "even things out" by stealing a little something.

    If you actually were threatened by the Police - the usual procedure is to ticket you and then you report for fingerprints and mug shots - then you need to report that Officer to the Police Department.
