My dad died 5/5/12 he has 5 grown children, none of us are really close,my aunt is the beneficiary, I live in another state but my brother (41)who has my dads identical name has been left out of EVERYTHING. I tried to find my other siblings but was discouraged, not sure if my dad left a will, but the aunt isn't talking, and they aren't contacting his kids about ANYTHING!. Im in NE, but I know the aunt, I was raised around her), so I know he is in for hell dealing with her, but if it comes down to me taking sides, I will side with my siblings. Is there anything my brother (s) can do to be included in our fathers estate? we don't trust the Aunt at all now, my dad had property, a small landscaping business, vehicles etc.. We think the aunt is up to no good, does my brother have ANY recourse at all, he was with my dad when he died they were together doing landscaping work that day, what can he do that won't involve a lot of money? This is in Detroit, economy is horrific there,he was supposed to be paid by my dad on Sunday and my dad died on Saturday. And now HE wants to take over the business, but they have hidden the truck/equipment etc.. he is going through a lot of changes now, any suggestions?

If the aunt is the beneficiary then there has to be a will. If there is a will she has to file it in probate court, ( not just take everything) Someone has to be appointed by court or by the will to administor the will.

If not will, it still goes to probate court.

The children get together hire an attorney and file in probate court to order her to disclose all information.
