    Multiple State - NY and PA
    Hi

    I am a NY resident and my employer is in PA and with held my 2006 taxes with PA. But I work for client in NY.

    Do I file taxes to NY or PA.

    I was told I have to file taxes to PA as Non- Resident and file NY taxes as Resident.:rolleyes:

    Did my employer really screw up with holding PA taxes rather than NY taxes. Is it a common practice or a mistake my employer did.

    Will NY ask me reasons for holding taxes with PA and not NY.:mad:

    Help is Appreciated.

    You need to file in PA as a non-resident and get ALL of the withheld income tax back.

    You'll need it, because you will have to file a NY state tax return and pay those taxes, plus a penalty for not having taxes withheld.

    This kind of screwup is all too common. You need to have a talk with your employer about it.

    Does this mean while I file my NY taxes I have to calculate penalty in my return or wait till NY gets back to me and asks for the penalty.

    Pay NO penalty when you submit the NY return.

    Instead, attach a statement to the NY return explaining what happen and ask them to waive the penalties.

    The worst that will happen is that they say NO and then bill you for the penalty.
