    Statutory rape in Canada.
Hello, I am 15 and my boyfriend is 20 (almost 21). Age difference does not play a factor between me and him but we are worried about the law. I will be 16 in a couple days and I want to know if once I turn 16 we are able to be together legally without statutory rape as a possibility. So I would really appreciate an answer really quickly without being judged. Can an almost 16 year old and an almost 21 year old be together legally? This is in British Columbia, Canada.

This year 2012, Canada changed the age of consent to 16, so yes he can use you for sex without being charged rape.

There are other issues that parents can do, to stop the dating, if they don't approve, but rape is not one of them

I assume that "being together" means intercourse or oral sex?

I know you don't want to hear it but PLEASE use birth control. What does someone 20 (almost 21), a college student, have in common with a high school girl of 15? I'm not criticizing. I just don't understand it.

The legal age is 16 for you. Here's the law.

You are 5 years apart (obviously).

"It is now illegal for adults in Canada to have sex with a partner under the age of 16, one of the new provisions of the Tories' violent crime law.

The Tackling Violent Crime Act raises the legal age of sexual consent in Canada to 16 from 14, the first time it has been raised since 1892.

But the law includes a "close-in-age exception," meaning 14- and 15-year-olds can have sex with someone who is less than five years older.

The Tories said they raised the age, in part, to deal with internet predators. The new law puts Canada's age of consent in line with those in Britain, Australia and most of the United States."

As noted, He cannot be prosecuted for underage sex once you turn 16. But if the sex started before you turned 15 he could be.

However, if your parents don't consent to the relationship, then he could be prosecuted for parental interference among other things.

Sorry, it doesn't work that way. Once you post a question like this you open yourself up to being judged. You claim that the age difference isn't a factor, but obviously it is. Otherwise you wouldn't have had to post this.

The truth here is that this relationship is totally inappropriate. You are too young to deal with such a relationship and he should know better. Clearly sex is on the table, hence your question. For him to even discuss sex with you shows that he is likely a predator.

You haven't supplied information about how you met, how long you have been in this relationship or what your parent's think of it (if they even know about it),

I hope you let us help you by supplying more information that might change our feelings about your relationship. But based on what you have said so far, this relationship is wrong.
