    visitation flight risk
    What rights does the custodial parent (sole custody) have if the now ex-husband and father of the 2 children was supposed to pick up the children at a family visitation center here in Illinois, but he did not cooperate and only showed up one time. The family service center since dropped the case because of his not cooperating. The custodial parent showed up at the center for a few months, but the father never showed. After 9 months the father went to a local police station claiming the custodial parent did not follow the visitation orders, which is not true. He was the one who did not show up at the center to exchange the children. Our visitation order states the exchange is to take place at the visitation center. Since our divorce the ex has also moved out of county to a new county, and has married to a person from Mississippt. He constantly calls to threaten that he will take the children and I will never see them again. He is moving to MS. sometime. Do I file an EOP or a change of visitation. He is a flight risk because of his threats and his past actions which included not returning my son for a year during a visitation until the court ordered him to show up and return my son.

    The current order is in place and that is the current order, you will need to go back to court to change the current order.

    But so he went to the police, who tells him it is a family issue and they can't get involved.

    The issue with custody order, that is when he is allowed, but they can not force him to pick up the child. So I am sure you have documents from the center to prove he never showed up for a number of months, you will need that for the new hearing.
