    Can I get a restraining order against my parents?
    I am filing for emancipation and I am wondering if I can file a restraining order against my parents so that they can not touch me and hurt me.

    Hello tory:

    If your parents are hurting you physically, call CPS (or whatever they're called in your state). A restraining order won't work!!

    OK but what I need to know is that I plan on getting a emancipation and I don't want to be home when they get served problem is is that I don't know when they are getting served and I am staying at my girlfriends house so, why wouldn't a restraining order work though? And all cps is going to do is take me away I Don't MOVE because of my parents, is there anything else I could do?

    A restraining order won't do it, because it requires them to stay away from you. You can't do that if they're living in the same house as you, so it WON'T be granted.

    CPS won't do anything to YOU. If they do anything, it will be to YOUR PARENTS.

    But, maybe you don't have to do anything LEGALLY... just yet.

    Move in with your girlfriend. Write a letter to your parents. Send it certified, return receipt requested. Tell them that you COULD have called CPS again on them, but that you want to avoid that kind of drastic measure, and you want to save your parents from having to deal with the legal system again.

    However, if they don't agree to the emancipation, YOU WILL.

    You said you are filing for emancipation? With who? To get emanicpated, you would need to go through your local Family and Children's services agency. If you tell them the reason why you are seeking emancipation, they will, most likely, place you in a foster home (or with your g/f) until the case can be resolved. They will provide protection from abuse by your parents.

    All this should have been explained to you when you filed (or file) for emancipation.

    Thanks for everything to the people that helped me, my dad was fine with it my mom freaked out and basically disownned me. So I get to move today in with my girlfriend. BUT THANK YOU FOR EVERYTHING
