    My biological father name is not on my birth certificate
    My biological father died September 2006 I found out about his dealth and burial October 2006 by a phone call my mom received from my bioligical father's sister-in-law. My biological father's name is not on my birth certificate at the time my mother and he were married to different people and I was a result of the affair. How can I change my last name and have him added to my birth certificate.

    You basically cannot. Was DNA performed?

    Your mother's husband is legally your father unless he filed paperwork which I'm not going to explain at the time of your birth.

    Did he ever acknowledge you as his child, make provisions for you in his Will, pay child support?

    This is a question about law, not emotional wellbeing, although I understand why you would be upset.

    Do you want legal suggestions or emotional support?

    1. How old are you ?

    a. You will not most likely get him added to your birth certificate, if your mom was married to someone else, at the time of your birth, they are considered the legal father, unless either he or the real bio dad contested this at birth.

    So there really is little you can do, esp with him dead to have him added to your birth certificate.

    ** if you are over 18 and want to change your name, you can go and do a legal name change at the court house, which just changes your name.

    Yes he did acknowledge me as his child as far as child support no, will no, DNA
    No but he did have other 5 children with his wife. Is it anything I can do legally with the other children he had as proof to change information on my birth certificate?

    Why are you interested in doing this? You can simply legally change your name through the Courts whenever you want to whatever you want.

    You can also approach his wife and children about DNA but they do not have to agree.

    Are you intending to claim part of his estate?

    Are you in the Will? Were you left out of the Will? Something else?

    If it's a question of inheritance and he DID acknowlege you have you talked to an Attorney - although this is six years ago.

    Or is this more about putting your mind at ease?
