    Problems with ice
    This all happened in gwinnett county ga

    Maybe some one can help me my husband got a cocain possession under first offender act in 2003 and now ice has him in coustady wanting to deport him all this happened in gwinnett county ga. And ice said the first offender act does not work for them can some one help me please

    Kiss him goodbye... One criminal violation will get a green card revoked... a Visa revoked... and deported... and likely will never be allowed to reenter legally.

    You don't get a second chance if your aren't a citizen. You get sent back home.

    What is his immigration status, green card, visitor visa ?

    There will be a hearing, as long as he is not in the US illegally an attorney may help

    Well the attorney said uless I get it off his record he will be deported the attorney but the aid I could get it vacated but it will cost me $5000.00 dollars and I don't have that tap of money I am self employed

    And me and my husband have a small paint company and we take care of my disable mom our daughter and her three kids, and he was the back bone off the company he did the specailty painting, so with out him my company is going to crash and burn and I wamt even be able to suport myself must less our familey

    That's how it is... he got busted on a cocain charge... families get separated and businesses go under every day... a crime is a crime... and as was a famous line from a popular cop show in the 70's "Baretta" "....Don't do the crime if you can't do the time."

    Meaning... none of what you just said matters when his case gets heard and if he did what he was accused of and he loses... then you are going to be looking for another means to make money. And if he isn't a citizen... he will likely have his papers revoked assuming he is here legally now (upon a conviction)... and if he's not legal now... then he's going to be gone regardless of the outcome.

    Agree with Smoothy - there are plenty of criminals in the US now. ICE frowns on importing/allowing more to live in the US.

    You need a good Immigration Attorney. Maybe he'll take payments. I don't know. You need to weigh the cost of the Attorney against what will be lost if your husband is deported.

    Or make plans on moving to his country to be with him there.

    I don't see getting the charged removed, esp at this point. But the county you are in now, is one of the more pro immigration ones in the area. So if it will happen anywhere it will happen there.
