    How do they prove that my wife and are separated food stamps
    My wife has been arsted for food stamp fraud because they include my income .but we have been separated the whole I'm disabled from ms

    Are you saying you aren't separated? Can you prove you live together?

    She ( since it is her issue) proves that you and her have difference address.. Provide rental or lease info for each. Provide copies of Drivers license showing correct addresses.
    ** assuming you are wanting to show you live at different addresses.

    The trouble may be the rules of the food stamps in your state. Did you file a legal separation with the court house ?

    I'm re reading this and scratching my head. Why would they arrest her fro fraud for INCLUDING YOUR income when you don't live together? Since food stamps are income based, overstating your household income would reduce your eligibility. So why include your income if its not part of the household? Something doesn't sound right here.

    I'm confused too. The only way this possibly makes sense is that he is saying that they believe his income should have been reported.

    If that's the case, the burden is on the prosecution to prove that they were living together during the pertinent time. OP's wife could attempt to rebut whatever proof they offer with testimony by OP, OP's wife, other witnesses, as well as documentary evidence such as suggested by Fr_Chuck.

    I don't think a driver's license would be very probative. DMV doesn't check to see if the address you report is correct. But also utility receipts, post office records, etc. might work.

    Agreed. It could be fraud if his income was not included AND they did live together.
