    What will the penalty be for a juvenile who has stolen an item over $300?
    While at school on Friday my son stole an Iphone with a value of over 300. He was also arrested in January for a misdemeanor marijuana charge and is currently attending a diversion program. What will his the penalty be? Fines? Jail time? My husband is in the military and we are due to transfer early next year. Will my son be able to leave?

    He will not get a diversion program. Next how old is he, will he have court in adult court or juv court ( if he is 17 it can go either way on some charges in some states)

    My guess about a year probation, maybe a few counseling classes, a fine to pay. They may since this is a second offense and they may even "think" he was stealing to buy more pot, so they will look close at drug testing most likely. Since this is a second offense they may also order a home study to see if anything in the home environment could be the cause of this.
    Not saying it is, but this is what often happens.

    They may do a shock if putting in in detention for a few weeks, but it just up to the judge and their opinon on this.


    You will have to get the PO departments to approve any move or transfer of probation, and that can take one to two months at time.

    He is 16. They have been giving him drug tests throughout the diversion program, and all have come back negative. Unless he smokes at school, it would be all but impossible for him to do it here without being caught. We go through his back pack and pockets as soon as he arrives home from school, and I am a stay at home mom.

    I have already set up some counseling appointments for him. He has not been to one yet, but will have before he goes to court.

    I honestly wouldn't mind if they looked further into our home life. I will do just about anything to see that he succeeds in changing his behavior for the better.
