    One year lease is up now switching over to month to month rental
    I live in Florida I had a one year lease that has been up for some time now in the lease it states that once the one year is up it switches over to month to month rental. What does that mean am I no longer bound by the terms of the original lease? We have been living here for about 3 years now and have not signed anything but the original first year lease.

    No, you are still bound by most of the terms of the original lease. However, since it is month to month, the owner can change your rent with very little notice. You are he can give 30 notice that the tenancy will terminate.

    No you are still bound by most of the terms in the lease. You can give notice as allowed in the lease to move and they may give notice to raise the monthly rental

    You are bound by all the original terms except expiration date and rental amount. The expiration date is the end of each month. The landlord can give you 14 days notice (according to FL law) to vacate. But I believe they have to give a month's notice to raise the rent.

    If LL wanted to raise the rent, he or she could, then, simply give the 14 day notice to vacate, with an alternative that tenant starts paying raised rent. So, unless I'm missing something, it would be, as a practical matter, 14 days in either case.
