    Want roommate out (This is Good Reading at least!)
    My mother and I are joint-tenants on a lease. It was set up that way because the landlord wanted me to co-sign for her (I had my own apartment at the time). Since she is on a fixed income, the plan has always been for her to have a roommate to help with the rent. She currently rents the spare room to a young man who, although amenable, is consistently in arrears on the rent, causing my mother no end of stress. I have acted on my mothers wishes in the past, and taken the stance of "bad guy" to get him to pay rent, but all backfires when she goes soft and he somehow works his way into her good graces again. The latest issue arose when it was discovered that the chemical THC was found in my mom's system... No judgement on anyone's part, but we all know where that smell comes from... Recent events have led my family to the conclusion that regardless of how mom feels, the roommate has got to go.

    1. Since only myself and my mom are on the lease, do we have to follow any procedure to get him out if her/our house?

    2. Can the roommate go directly to the landlord and enter into any kind of agreement with the landlord.. Sounds really freaky to me, since my mom and I are legally still tenants.


    There's so much more than this, but I thought I'd start easy...

    No its up to you to he's not on the lease so he has no say on what goes... maybe if he knew the landlord on a personal level then he might have a say but I'm sure its up to u too...

    Hello some:

    Look, your mom and her buddy and having a good time. Why do you want to be a spoil sport?

    In any case, the roommate is a tenant and you need to evict him according to your states landlord/tenant law. There's a sticky at the top of this forum where your states law is available.

    Can the roommate make a deal with the landlord?? YOU already have a deal with the landlord. HE can't make one that will supersede yours. Of course, I guess he can rent another apartment...

    Sorry, Excon. I wanted to agree but I have to spread it around. Someone, you and your mother have subletted so you two are the "sublandlords" and he is the "subtenant". That means that the two of you have to go through the legal eviction process with him. That means giving him written notice and filing a lawsuit for eviction if he doesn't leave when the notice period is up. Check the sticky at the top of this forum for your state's landlord/tenant laws.

    Hello again, some:

    Ok, I'm ready for the not so easy part.

    In the first place, THC doesn't show up on any routine medical tests, so it wasn't just DISCOVERED. She was tested for it. Why? Did she get tested for STD's too?

    You said it makes good reading... Come on, tell us the good stuff.
