    Person will not move out of dead grandmothers home
    Grandma passed on a few days ago. Left house to both children but a friend of a friends housekeeper had been staying there for several months as my grandma was needing companionship and help cleaning. During the last few months family was coming to help with hospice in and out as well. The friend of a friend was in jail and when she got out took over the room once again. There were no lease agreements signed only good faith understanding that she would find a place and be out when grandma passed. Now her attitude has changed and she says she needs 30 days every couple weeks and has threatened to get a restraining order against the half owner< grandmas son who has asked her and her son to leave.What rights do we as family have? Also belongings are beginning to disappear.

    If there was an agreement that she live there until Grandma died, you need to give her time to move out. A 30 day notice should be sufficient.

    You also need to do a complete photographic inventory to prevent theft.

    Probably none (assuming the house is still in Grandma's name), unless a probate case has been filed and one of you has been appointed personal representative.

    The family has the right to give notice and enter the house and do an inventory of all the property, if anything is missing latter you sue them for their value. They will have to be given a written ( stop just talking to them) notice to move out, if they don't then file for eviction in court.
