    Legal Question for Ontario I am Confused
    Hello one day as I was going to the store I was approached by two men who tried to indimidate me to rob me and where trying to get their hands in my pockets, I said what the hell are you doing and removed his hand from my pocket and tried to back away.

    One of them then punched me in my mouth and knocked me down to the ground I tried to push him off and he punched me again in my eye he then pinned my arms down and told the other guy "check his pockets quick" at this point I was yelling for the police and a bus had stopped to watch the other man stopped going through my pockets then I yelled help help get off me someone call the police.

    The police arrived really fast in one minute and the man who was holding me down quickly got off when he saw them. I told the police exactly what happened and when they talked to the two other men they said I punched him in the face, he had no marks on him at all and my head was bleeding, I had a black eye, swolen lip, bruised ribs from his knee and bruises on my back from when he knocked me down.

    I was told I was under arrest for assault and as much as I tried to explain and reason with the police officer they ignored me the other two men where let go at the scene I had been drinking alcohol and I suspect this might have been a factor of the police beliving that I was the one who assaulted them.

    I was taken to the hospital for my injuries. They where going to take me into the police station for booking after this but at this point I felt this was very unjust and I was getting desperate so I asked to speak to the doctor in private I told her I suffer from severe anxiety issues which is true and that if I was taken to jail I could not handle the situation and that I'm feeling suicidal. At this point I was signed over to the hospitol on a psychiatric form.

    Before the police left they worded it to me like this as they got off the phone with the detective "the detective is letting you go but there might be a warrent for your arrest later". The crisis unit in the hospitol spoke to me soon after and I explained everything to them and told them I am not suicidal but desperate to not be put in jail due to my anixety and that I was the victim of the crime, I was soon released to go home from the hospital.

    So to sum this all up I am wondering why the police said there "might" be a warrant later instead of giving me some kind of summons to appear in court? did the detective decide I was not at fault or has he not decided if the charge will be official yet? Does the detective need more time to get the information on what happened before he goes to a judge to issue a warrant?

    I am just confused if someone could explain to me from the information I provided what is the most likely course of action the police are taking if any, thank you.

    They were going to give all the info to the crown who would decide if they were going to press charges. Then they would issue a warrant for you.

    If you are not sure, you can contact the dect who was doing the case, but personally I would just let it go.

    Thank you for that information do you also know by how long I would know if there was a warrant for my arrest and would they be coming to pick me up at my home or only if they ID me outside for whatever reason?

    I would say you should know something within 3 to 6 months for sure, but honestly if they were going to arrest you, they would have done it that night, I see almost no chance that they would still come after you.
