    Will IRS intercept if non custodial is current on arrears payments.
    I have two children both are over 18. Their father pays support to me weekly but only because he has arrears in the amount of $30,000. Will IRS intercept his refund? I don't owe the state a dime. I received a refund check two years ago none since they are adults.

    It depends if the state filed the required paperwork with the IRS to garnish his refund.

    If they did, the IRS WILL confiscate his refund and send it to the state.

    If they did not, the IRS will do NOTHING!
