Can I be sued in NY state for not paying a medical bill? The company employes a anesthesialogist that "screwed up", his words not mine. He gave me the wrong drug and almost killed me. I cannot sue them because I didn't die. Go figure. But they want payment for his serves and they sent it to a collection agency but I don't want to pay him for his screw up that almost killed me.

? Of course you can sue them, who told you that you could not ? You file a law suit and then reach a settlement where they drop their bills.

But yes of course they may sue you. You have a bill, you have not been to court to prove you don't owe it. They may sue you.

Only if OP suffered damages. If he "almost" killed, lray32, he/she "almost" suffered damages. That doesn't cut it.

But I'm wondering why this question is in the "Crimina Law" subforum. lray32, do you understand that if he were to sue you, that would be civil and not criminal?

Anyone can sue anyone over almost anything. So if you were told you can't sue, you were told wrong. But if you were told you can't win a malpractice suit, that's a different story. As AK said. Unless the mistake resulted in permanent harm to you, you couldn't win. On the other hand, defending such a suit would be damaging to the doctor's rep, so he might be willing to waive his bill instead.
