    J1 visa - status for Mass tax return
    Hi,

    I am on a J1 research visa and I came to Mass. In April 2011. Since for the federal return J1s are excluded from residency, I was wondering which status I am in MA. Part year resident or non resident? Or both?

    And can I claim any deductions for my J2 wife and my US citizen son born in November?

    You would be a part year resident for MA.
    If you and your wife came to the US on the same day, you can file a joint return for MA, otherwise you would need to file separately.
    You an only claim dependents on your MA return that you were allowed to claim on your federal return.
    MA recognizes federal tax treaties, so if you are eligible to claim one on the federal return, you can claim it on the MA return as well.
