    Filing as resident aliens
    My husband and I and our three kids have been in the states for 6 years continuously, he is on an F1 visa and I am on an F2 visa. Only my third child has been born in the states on 2009. Now do we file as resident aliens this year? And what forms do we need to fill for our dependents?

    After 5 years on F1, your days in U.S. are not exempt from residency. So after 5 years you will file resident tax return.

    You will file Form 1040A to claim the three children. Assuming your wife and two children need ITINs, you MUST submit Forms W-7 tpo apply for ITINs.
