    Foreclosures and tenant rights
    My family of 7 are being evicted whereas the landlord has foreclosed on his property. We have been here two years, haven't missed rent until he told us the news. We missed one month. We are low income and need legal rights/advice. We have been searching for a home for two months and have no place to go yet need to be out within 30 days. Also we can't afford relocating or deposits etc.

    First, ANY question on law needs to include your general locale as laws vary by area. Whether the landlord is undergoing foreclosure or not is immaterial to you until the foreclosure is finalized. Until that time you owe the rent. If you don't pay, then he can start the eviction process.

    What's not clear is whether you have been given a pay or quit notice or a termination of tenancy notice or what. If you were given a pay or quit you may be able to forestall that by paying what you owe and bringing your account up to date. Otherwise you do have to vacate by the deadline.

    If there is no lease, the landlord in most places can evict you with notice. If you do not pay rent, they may evict you faster. Even a property being foreclosed, the renter has to pay rent as long as they live in the property.

    There is no protection because you are poor, a court or judge will not force someone to allow you to stay if you are not paying rent.

    If they do the eviction, you may appear in court and try to get extra time, but normally this is only a few weeks at best.

    You will need to try harder to find a new place.
