8 years ago a mother and her ex husband willfully signed over full guardianship of their daughter over to the mothers parents. The child's grandparents on moms side of the family. Now the grandparents are wanting to return guardianship to the child's mother. The father is being very difficult to locate or contact. My question is can the guardianship papers be legaly finished without the father? Remember ing that he signed over guardianship 8 years ago, does he have any say? Wouldn't it be the grandparents and the court ond the mother who will be reciving guardianship that make the decision now. I'm confused. This is not a custody battle, everyone is in agreement, we just can't get ahold of the father.

Where? If the US, each state has their own laws about locating a parent. The court should tell you what you have to do to make a good faith effort to locate the father. It just might take some extra time. 'Missing' spouses do sometimes reappear and disagree with what is happening, and also claim that they were not missing at all, so courts don't always allow this to happen quickly.
