How do I get my son's girlfriend and her 3 year old daughter to leave my home?
My 44 year old son and his 2 children moved in with my husband and I almost 3 years ago. His girlfriend moved in a year ago.He told her she could stay a month or two to give her time to find a job and a place to live. Now she refuses to leave.I told her to leave and she said I couldn't kick her out. She said I have to give her notice. She contributes nothing.There is no rental agreement. She doesn't pay anything. She doesn't work. She is rude and I want her to leave. She also has a 3 year old daughter who is with her probably half the time. How do I get her out of my home? I live in Arizona.

I second that... serve them as JudyKayTee stated in that link... do it properly. And follow it to the letter. And in case its not clear... they don't HAVE to pay rent to be evicted... they have stayed long enough they have to be treated as any other tenant would.

How do I fill out eviction papers? Continued
I went to the courts and got the proper papers to get my 44 year old sons girfriend evicted as judykaytee advised. There was no contract to pay rent, just to let her live there for 1 or 2 months so she could get back on her feet. So how do I fill out the paper work when it just asks how much rent is the rentee behind? Do I figure how much it cost to pay for mortgage, gas, electric,& gas each month times 12 then divide that by the number of people living in our house? Or put down 0 moneys.

Explain that she was allowed to live there without paying rent, but that now you want her out.

Has the time limit expired? If it has then explain it. You made a goodwill effort to help them and now that the time has expired you want them out.

It doesn't matter. OP wants them out - OP can get them out, after going to court, assuming a notice to quit was duly served, etc.

I've merged your two threads. Please don't start a new thread over the same issue. Use the Answer options below to provide follow-up.
You indicate that there was not rental agreement but that the woman was given shelter for a limited period. You further indicate, that when asked to leave she refused. So that you are going through the formal process of evicting her to cover yourself legally.
But make sure you have followed the process. Did you give her a written notice to vacate and allowed the legal time frame to do so?

I will note that an issue will be if you don't evict your son also. If he is living at the home, he can tell them they can stay with him, he could even appear in court, testify he is a resident in the home and has told them they are welcome to stay with him.
So is the son going to back this up to get them out, or is he going to help fight the eviction.
